Hytera and ZTE Notice of Apparent Liability
The FCC proposes a $188,491 forfeiture against each of Hytera Communications Corporation Limited and ZTE Corporation and orders each company to publicly update its Covered List affiliate disclosures after finding apparent willful and repeated violations of 47 CFR § 2.903(d).
What it does The item finds that the companies’ March 8, 2023 filings did not fully identify subsidiaries and affiliates producing covered communications equipment, and that neither company subsequently filed required public updates. Hytera disclosed 60 additional entities in its 2025 response to a Commission letter of inquiry, 49 of which staff identified as potentially producing covered equipment. ZTE disclosed 15 additional entities, including 13 currently active entities, and staff identified 11 as potentially producing covered equipment. The FCC requires each company to file updated names and contact information for all covered-producing associated entities within 30 calendar days of the item’s release and to pay or contest the proposed forfeiture within the same period.
Who it affects The order directly affects Hytera and ZTE, their disclosed subsidiaries and affiliates, equipment-authorization applicants, Telecommunications Certification Bodies, and other stakeholders relying on accurate Covered List information.
Why it matters The FCC treats the disclosure obligation as continuing until cured and links transparent affiliation information to enforcement of the Secure Networks Act and Secure Equipment Act. The proposed penalty is the statutory maximum for each company, not a final forfeiture order.
